Ready for Talks if Forces are Removed: Maoists

With the Naxals facing the heat of an imminent concerted operation by security forces, a top Maoist leader today said the ultras were ready for talks "if there was ceasefire on both sides" and withdrawal of the para-military forces deployed in the naxal-hit states.

"The process of talks with the central government can only begin if there is ceasefire on both sides," top Maoist leader Kishenji today said.

Asked to comment on the Centre's condition that the Maoists should abjure violence and only then it was ready to sit across the table, Kishenji told PTI over phone, "The Centre is killing innocent people in the name of tackling the Maoists and they are asking us to abjure violence, which is ridiculous."

He said the Centre would have to withdraw para-military forces from the seven states -- Andhra Pradesh, Maharashtra, Chattisgarh, Orissa, Bihar, Jharkhand and West Bengal -- and treat the problems of tribals in a sympathetic way.

"Also both the Centre and the state governments will have to apologise to the tribals for the prolonged atrocity meted out to them and the consequent suffering from the time of Independence," Kishenji said.

Asked what should be the nature of the apology, Kishenji said without elaborating, "They will have to come to the tribals and apologise."

Reminded that Prime Minister Manmohan Singh had yesterday referred to the systematic exploitation and social, economic abuse of tribals over the years while emphasising on change of ways of dealing with them in the battle to win their hearts, Kishenji said, "It as nothing but an eyewash".

Kishenji said political leaders from the time of Independence have said the same thing as the Prime Minister, but little had been done. "We want an end to it," he said.

"If the government thinks that speaking about the people and their problems is waging war against the country, then be it," he added.

Asked about the West Bengal chief minister's visit to West Midnapore district where he is likely to announce a Rs 1600 crore package for the development of tribal areas in three districts, Kishenji said, "The people of the areas are fed up of these kind of promises. What the state government has done in the last 33 years is known to all."

No of listed PSUs to triple after govt's plan on disinvestment!The number of listed PSUs in the country is likely to triple in the months to come with the government on Thursday announcing a bold
disinvestment plan that seeks to list all profitable public sector enterprises.

At present there are around 55 listed public sector entities, and with today's announcement, the number could go up to over to 150, as nearly 100 others, including BSNL, qualify for the listing.

Meanwhile, the market cap of the 150 listed companies would represent a huge chunk of the total market cap of all the firms listed on the Bombay Stock Exchange.

At the end of today's trade the m-cap of the companies in the BSE PSU index stood at Rs 15.76 lakh crore, accounting for one-third of the total m-cap of BSE, which stood at around Rs 54 lakh crore.

The major surge in the m-cap tally would be from telecom major BSNL, an unlisted entity, whose valuation has been pegged at about USD 100 billion and a paid-up capital of about Rs 5,000 crore.

According to the CCEA's decision, unlisted firms with three-year track record of net profit and positive networth will have to come out with Initial Public Offerings.

In its second term, the Congress-led government has already paved the way for listing of two PSUs, NHPC and Oil India, and today's decision would result in more CPSEs hitting the capital market.

The shares proposed to be sold-off to the public in over half a dozen listed public sector entities, as part of the government's bold disinvestment plan announced today, are worth over a whopping Rs 25,000 crore at current market price.

he government on Thursday decided that all listed central public sector undertakings (CPSUs) would increase the public holding to 10% and all unlisted profitable state-owned entities should go public.

"All profitable listed CPSEs (central public sector enterprises or CPSUs) should need the mandatory listing of 10 per cent public ownership," home minister P Chidambaram told reporters after the meeting of Cabinet Committee of Economic Affairs here.

The government has also decided that all unlisted CPSEs which have made profit in the past 3 years and have a positive networth should get listed on stock exchanges, he said, adding that CPSEs would enter the market at "appropriate" time.

The decision will have a bearing on mineral major NMDC and MMTC as the public shareholding in these companies is 1.62 per cent and 0.67 per cent respectively.

As per SEBI regulation, listed companies are required to divest a minimum of 10 per cent of the equity to the public.

The minister further said the proceeds of the disinvestment would straight away go to meeting the capital expenditure of the government's social sector programmes, without being routed through National Investment Fund (NIF).

In pursuance of its disinvestment programme, the government had offloaded its stake in Oil India Ltd and NHPC in the current fiscal. It has also unveiled plans to reduce its shareholding in NTPC, Sutluj Jal Vidyut Nigam and Rural Electrification Corporation.

According to the CCEA's decision today, all the listed and profitable Central Public Sector Enterprises would have to maintain a minimum of 10 per cent public shareholding.

The listed CPSEs that are making profits and have public holding of below 10 per cent include trading firm MMTC, mining major NMDC, Neyveli Lignite, Engineers India, State Trading Corporation, Rashtriya Chemical, National Fertiliser and Andrew Yule.

If the shares in these companies are sold to the public at the current market price, then conforming to today's CCEA decision the government would be raising an estimated Rs 25,100 crore.

The government on Thursday announced a bold divestment plan that seeks to list all profitable public sector enterprises, a move that would see public offers by over 100 companies, including telecom behemoth Bharat Sanchar Nigam Limited.

The funds from such sale would be directly deployed for social sector schemes, instead of being routed through the National Investment Fund.

The divestment plan also requires already listed central public sector enterprises to ensure at least 10 per cent public holding, home minister P Chidambaram [ Images ] told reporters after a meeting of the Cabinet Committee on Economic Affairs, which was chaired by Prime Minister Manmohan Singh [ Images ].

According to the CCEA's decision, unlisted firms with three-year track record of net profit and positive networth will have to come out with Initial Public Offerings.

In its second term, the Congress-led government has already paved the way for listing of two PSUs -- NHPC and Oil India, and Thursday's decision would result in more CPSEs hitting the capital market.

At present, there are over 40 listed state-run companies and over 100 others, including BSNL, qualify for listing. CPSEs going to market would involve 'some disinvestment' of the government, Chidambaram said, adding that this would be done at an 'appropriate' time.

In another policy shift, the proceeds of the disinvestment can now directly fund the capital expenditure of the social sector programmes such as education and health care and need not be routed through the NIF.

"Because of fiscal constraints, a special dispensation is made for three years to directly channelise the money into the capital expenditure for social sector", Chidambaram said.

The unlisted companies which will be required to go public will include blue chip firms like Bharat Sanchar Nigam Limited, Rashtriya Ispat Nigam Limited and Coal India Limited.

As regards the listed companies, Sebi regulations require all listed companies should have a minimum public float of 10 per cent. Several listed public sector companies, however, have less than 10 per cent public holding.

The government's decision, said SCOPE executive director U B Choubey, "will bring out the hidden networth of the state-owned companies. . .They (CPSEs) are ready and will come out with their public issues."

The corpus collected from the disinvestment, he added, should be used for expansion and modernisation of CPSEs and social sector programmes of the government.

The government had recently unveiled plans to reduce its shareholding in NTPC, Sutluj Jal Vidyut Nigam and Rural Electrification Corporation.

During the current fiscal, the government raised Rs 2,013 crore (Rs 20.13 billion) by offloading its shares in the hydro-power major NHPC and Rs 2,247 crore (Rs 22.47 billion) from stake sale in OIL.

As per the disinvestment policy of the United Progressive Alliance [ Images ], the government is committed to offloading equity in public sector undertakings while retaining 51 per cent stake.

"The public sector undertakings are the wealth of the nation, and part of this wealth should rest in the hands of people. While retaining at least 51 per cent government equity in our enterprises, I propose to encourage people's participation in our disinvestment programme", Mukherjee had said in his Budget speech in July.

Govt okays major easing of FDI norms

Retail, telecom, media and a host of sectors in which foreign direct investment is restricted stand to gain from changes in FDI policy that the Cabinet Committee on Economic Affairs cleared on Wednesday linking approvals to the concept of control for the first time.

The new norms were proposed by the Department of Industrial Policy and Promotion and discussed by a Group of Ministers on February 3.

"The objective of these new guidelines is to make FDI norms simple and transparent according to DIPP," Home Minister P Chidambaram [ Images ] told reporters today when he announced the new measures.

The new measures will be implemented with prospective effect. Government sources said two Press Notes - policy documents governing FDI norms - of the 2009 series will be released in the next 10 days.

Under the new guidelines, downstream investments by an Indian company that has foreign investment but is "owned and controlled" by Indians will not be considered FDI.

"Owned" in this context will mean having a more than 50 per cent shareholding and beneficial ownership. "Controlled" means that the owners will have the power to appoint the majority of board directors and legally direct the board's actions.

"This means there is a huge opportunity for Indian-owned and -controlled companies to bring in FDI and then undertake downstream investments, without bothering about sectoral limits or restrictions," said a senior government official.

However, if the investing Indian company is foreign-owned and controlled, then its entire downstream investments will be considered indirect FDI.

But there is an exception. If the foreign-owned and controlled Indian company undertakes downstream investments in 100 per cent owned subsidiaries, the amount of indirect FDI will be equal to the percentage of foreign investment in the Indian company.

"Although the proposed policy puts to rest the debate on computing FDI in sectors in which limits apply, it also implicitly allows FDI (without control) in all sectors and industries through downstream route. For instance, FDI is currently prohibited in multi-brand retail, real estate trading, gambling, agriculture etc.  If these sectors are not excluded from the proposed policy liberalisation, this is definitely a leap," said Akash Gupt, executive director, PricewaterhouseCoopers. Some Indian-owned companies in sectors like telecom may get more room to bring in additional investment, said analysts.

But insurance, in which the government is proposing to increase FDI to 49 per cent from 26 per cent, will be kept out as it is governed by an Act of Parliament, the official said.

Retail, in which FDI is only allowed in single-brand and wholesale cash and carry business, is likely to benefit to a great extent because of the new guidelines. Many foreign players currently operate through the franchisees. "If foreign investments can be routed through Indian-owned and -controlled companies, overseas retailers will definitely like to be a part of this," said a Dehi based analyst.

Businessmen in sectors like real estate, however, are not upbeat about the new FDI rules. "First, the foreign investor may not be enthusiastic about a minority interest where he cannot have control in the joint venture company or over the project for which the investment ultimately flows in," Sanjay Verma, executive MD, South Asia of international real estate consultancy Cushman & Wakefield.

But, he added that from realtors' perspective, the change in FDI policy will help them tap foreign investments in sectors in which FDI is not currently permitted. For instance, small projects that are less 50,000 sq metres or projects that are completed are not eligible to attract FDI on Wednesday.

The new guidelines have also made government approval mandatory for transfer of ownership and control of Indian companies to overseas firms and individuals. This was done after concerns were expressed in various quarters of government on ownership of companies being transferred in sensitive sectors like telecommunications and defence to foreign entities.

For example, FDI up to 49 per cent is automatic in sectors like telecom, which has an overall limit of 74 per cent. "This moves ensures uniform norms for all sectors with an FDI cap," the official said. Companies will also have to furnish ownership details in Indian companies. In addition, inter-se agreements, which refers to agreements amongst shareholders on appointment of board of directors, voting rights or creation of voting rights disproportionate to shareholding, will have to be furnished while applying for FDI.

Maoists Killed Saraswati to Get Support from Christians

Maoists might have killed VHP leader Laxamananda Saraswati for securing support of the minority Christians and expand their network in Orissa's Kandhamal district, the Commission probing the murder was informed here today.

"Maoists might have killed Saraswati to get the support of Christians," former Inspector in-Charge of Kotgarh police station H K Pradhan told Justice S C Mohapatra, probing the killing of Saraswati and the violence thereafter.

Noting that the minority community in Kandhamal was not accepting Saraswati's campaign against cow slaughter and religious conversion, the field level officer said many houses were set ablaze and some churches attacked in Kotgarh area a day after the killing of Saraswati on August 23, 2008.

Though no case relating to conversion was registered at the police station, Pradhan said seven people were arrested for rioting and arson. "Land dispute between tribal Kandhas and Pana Dalits added fuel to the riot," he said.

He claimed though a riot broke out in Kotgarh area, the police were not armed as all weapons were withdrawn from the police station.

 

Sri Lanka Hints at LTTE-Maoist Links

A top Sri Lankan official today said the rebel LTTE may have had links with the Maoists in India, days after Union Home Minister P Chidambaram said that the left wing extremists were acquiring arms from abroad.

"Going by the way they (LTTE) operate and plan things it is possible that they can have links with any terrorist organisation like the al-Qaeda and the Maoists," Rajeeva Wijesingha, secretary in the Ministry of Disaster Management and Human Rights, told PTI.

He said the links could have been there through training of operatives.

"Their (LTTE) motive is destabilisation of any country," Wijesingha said adding, slain Tamil Tiger supremo Velupillai Prabhakaran had a "visceral hatred" towards the Indian government.

In an interview to PTI on October 24, Chidambaram had said the Maoists were acquiring arms through Bangladesh, Myanmar and possibly Nepal.
 
HC Restrains Police from Narco Test on Ghandy

The Delhi High Court today restrained the city police from conducting narco analysis test on top Maoist leader Kobad Ghandy.

Justice Indermeet Kaur stayed the trial court's order which had on October 31 allowed conduct of the test on the 63-year-old top Maoist leader.

The court passed the order after Ghandy's counsel Rebecca M John submitted that until and unless Constitutional validity of narco test is decided by the Supreme Court, an accused cannot be forced to undergo such a test.

She submitted that the Supreme Court has been consistently denying such a test on accused in view of the pending case before it in which a Constitution bench has reserved its order.

The High Court also issued notice to the police and directed it to file a status report by December 14.

Ghandy approached the High Court contending that he cannot be forced to give evidence against himself as it violates his right under Article 20(3) of the Constitution and he had not given any consent for the test.

The trial court had on October 31 allowed the police to conduct narco test on Ghandy, arrested from the national capital on September 20, after the probe agency contended that it had not been able to elicit all information from him despite use of all scientific methods of interrogation.

The trial court had passed the order after going through the medical report submitted by AIIMS which said Ghandy was medically fit to undergo the test.

Challenging the order, Ghandy said the validity of such an invasive test is still not clear as the matter is pending before the Constitutional bench of the Supreme Court which has reserved its order on the issue.

Ghandy, who has been booked under various provisions of Unlawful Activities (Prevention) Act, submitted that the magistrate should have waited for the Supreme Court judgement.

If Manmohan Singh heaved a sigh of relief this morning, professors whose frontbenchers bunk class would have sympathised with him.

Barring Patnaik, no chief minister from the states expected to counter Maoists through tribal welfare turned up for a New Delhi meeting partly named after them. The two-day event is titled "Conference of chief ministers and state ministers (forests/tribal development) to review the implementation of forest rights and tribal development programmes".

A tribal welfare ministry official said the department had specifically requested chief ministers of Bihar, Bengal, Chhattisgarh, Jharkhand, Andhra Pradesh, Madhya Pradesh and Orissa, all states with Naxalite presence of varying intensity, to attend the conference the Prime Minister kicked off.

"We had specifically asked chief ministers of Naxalite-affected states to attend the meeting. We hoped it would send out positive signals to the tribals and to the rest of the world. But apart from the Orissa chief minister, nobody cared to attend," the official said.

"Even states like Bengal and Tripura which write to us every other week seeking amendments to the forest rights act did not care to send their chief ministers to the meeting which discussed all issues related to the act," he added.

The Bengal chief minister was busy today reviewing plans for weekend meetings in West Midnapore, the Maoist-affected tribal belt, where Bhattacharjee will review welfare efforts and law and order.

"This needs extensive homework. Also, the chief minister wanted to be in Calcutta to keep track of the situation in Arambagh where Mamata Banerjee held a meeting today after clashes in nearby Khanakul," an official said in Calcutta.

Bengal did send forest minister Ananta Roy, backward classes welfare minister Jogesh Burman and his department secretary Nurul Haque to the Delhi meeting.

"The chief minister could not come as he had other preoccupations," Roy said.

A senior Bengal official said: "Two ministers went and that was enough to accord importance to the programme. Delhi has this habit of inviting the chief minister or the chief secretary to every event but it's not always possible for them to accede to such requests."

Earlier, too, Bhattacharjee had skipped a meeting convened by Manmohan Singh in Delhi on the Maoist problem. His secretariat had then said Bhattacharjee wasn't well.

The tribal welfare conference has assumed significance against the backdrop of the growing Maoist threat and a perception that the government was keen on a security solution before focusing on development initiatives.

Inaugurating the conference, the Prime Minister said there had been "a systemic failure" in giving tribals a stake in the modern economic process.

He said the alienation that had grown over decades was taking a dangerous turn in some parts of the country but "no sustained activity" was possible under the "shadow of the gun".
