Dear Friends
This is further to our circular dated 15th Jan, 09 wherein we had given a brief analysis of the 51 Members of Parliament (11 from Rajya Sabha and 40 from Lok Sabha, representing 14 States and 17 Parties) who participated in the debate on the Unorganised Workers Social Security Act 2008. The main concern we had expressed was that although many MPs pointed out several weaknesses in the Bill and suggested that the changes recommended by the Standing Committee for the Labour Ministry be adopted, nevertheless the Bill was passed without any of those amendments.
During the electoral campaign for the 16th Lok Sabha, Justice V.R. Krishna Iyer wrote to the leaders of all the political parties and to all main candidates to incorporate the demands of the Unorganised Sector Workers in their Election Manifestos and the election campaign.
With a new UPA Government in place, we have to re-plan the Campaign to ensure that the Unorganised Workers Social Security Act, 2008 is amended and made effective. A meeting of the NCC-USW will be organized on 28th July, 09 at ISI, Lodi Road New Delhi to plan the strategy for reconsolidating the campaign of Unorganised Sector Workers.
Further, in view of the NCC-CL Public Interest Litigation in the Supreme Court of India, there is urgent need to hold a national meeting on the status of implementation of the two Acts on Construction Labour. A meeting of representatives from different states will enable us to prepare replies to the responses received from different State governments to the PIL. A meeting will be organized to discuss Construction Workers' issues on Tuesday 28th July, 2009.
A session will also be held to discuss the proposed ILO Convention on Domestic Workers.
A need has been felt to form a national, grass-root linked platform of organizations working with different segments of the Unorganised Sector Workers. A meeting of independent unions and other organizations will be held on July 28, 09 to explore the possibility of the formation of a National Federation.
29 July Meeting on Migrant & Bonded Labour Study
During the past six months the NCC-USW, along with various constituents, had undertaken a survey of migrant and bonded labour in 20 States. Regional meetings of the study teams were organized in Bangalore, Delhi and Kolkata. State Reports of these studies are to be prepared by mid-July. A legal workshop will be organized on 29th July, 09 to discuss the changes required in the Bonded Labour System (Abolition) Act, 1976 and the Inter State Migrant Workers (Regulation of Employment and Conditions of Service) Act, 1979 in view of the observations of this study. These State Reports will be consolidated into a National Report by August end this year.
On either 28th or 29th July we will also organize a late evening meeting with Members of Parliament, provided that Parliament is in session at the time.
