Representation of women members on Selection Committees/Boards Mandatory

 

New Delhi : July 9, 2009

 

Government has initiated steps to ensure better representation of women members on various Committees/ Boards concerned with the selection to posts in Central Government and also to monitor the trend in recruitment of women. Accordingly, DoPT has written to the secretaries of all Ministries/Departments of GoI, UPSC and SSC to instruct all appointing authorities to scrupulously observe the following guidelines:-

 

(i) The composition of selection Committees should be representative. It should be mandatory to have one woman member in the Selection Boards/ Committees for making recruitment to• ten (10) or more vacancies and lady candidates are expected to be available for the service / Post.

 

(ii) Where the number of vacancies against which selection is to be made is less than 10, no efforts should be spared in finding a lady officer for inclusion in such Committees / Boards.

 

(iii) In the event of such an officer not being available in the Ministry / Department itself, there is no objection to nominating lady officer from any other office at the same station.

 

(iv) Wide Publicity should be given to all appointments in Government, Advertisements should be issued in the language (s) spoken by large number of people of the State/UTs, apart from English and Hindi.

 

Earlier, the Govt had issued such guidelines for various Committees/Boards concerned with selection to Group C&D posts only.

 

Further, for Group'C' level Posts, having only basic qualifying requirements, information about vacancies for recruitment should also be disseminated through schools and colleges in that area, in addition to normal channels.

 

With a view to monitoring the trend in recruitment of women, all Ministries/ Departments are requested to submit a consolidated report including attached/ subordinate offices on the total number of posts and employees group- wise and gender wise as on 31.03.2009 latest by 31.08.2009. The consolidated annual position as on 31st March of every year may also be furnished thereafter by 30th May of that year.

Budget for Youth and Sports

The Revised Estimate for the financial year 2008-09 of the Ministry of Youth Affairs and Sports was Rs.1311 crore (Plan). The Budget Allocation of the Ministry for the year 2009-10 is Rs.2699 crore (Plan). This information was given by the Minister of State for Youth Affairs & Sports, Shri Pratik Prakashbapu Patil in the Rajya Sabha today, in a written reply to a question by Shri Rama Chandra Khuntia.

 

The Minister further stated that in order to increase sports activities, the Government of India has launched a nationwide scheme for the promotion of rural sports infrastructure. Under the scheme, which has been named as Panchayat Yuva Krida Aur Khel Abhiyan, all village and block Panchayats and their equivalent administrative units will be provided with basic sports infrastructure in phased manner over a period of 10 years by covering 10% each year. The scheme also provides for organizing rural sports competitions at block, district, state and national level. The scheme is expected to promote mass participation in sports among youth leading to a healthy and socially inclusive society and participation of youth in community development.

In so far as increase in youth activities are concerned, the strategy of the Ministry is to help bring about social transformation in rural areas by promoting and developing among the youth, awareness and commitment to values of national integration, discipline, secularism and citizenship. The Ministry also strives to imbibe a spirit of voluntarism and community service in the young minds of students. In order to achieve the above, the Ministry has already initiated action to expand the programmes of the schemes namely, Nehru Yuva Kendra Sangathan, Scouting and Guiding and the National Service Scheme

Till 31st March, 2005, the Ministry was supplementing the efforts of the State Government for creation of Sports facilities including construction of Stadia, Sports Hostels and other sports infrastructure. However, with effect from 01.4.2005, the Centrally Sponsored Scheme of Creation of Sports Infrastructure was transferred to the State Sector and only committed liabilities were being considered upto 31.3.2007 as per the relaxation given by the Planning Commission. As such, no fresh case could be considered for Central financial assistance for construction of new Stadia and Sports Hostels in five years under the erstwhile Sports Infrastructure scheme.

Under the scheme of Panchayat Yuva Krida Aur Khel Abhiyan (PYKKA) launched in 2008-09, a total financial assistance of Rs.250.78 crore was sanctioned to 24 States for creation and maintenance of sports infrastructure in 22854 Village Panchayats and 601 Block Panchayats, out of which a total amount of Rs.83.15 crore was released during 2008-09 towards the first instalment.

To a question regarding assistance being provided to Orissa State, the Minister informed the House that under the scheme of Panchayat Yuva Krida Aur Khel Abhiyan (PYKKA), Orissa State has been sanctioned the admissible financial assistance of Rs.7.34 crore for creation of sports infrastructure in 623 Village Panchayats and 31 Block Panchayats during 2008-09. The first instalment of Rs.3.67 crore has also been released during 2008-09.

Further, Sports Authority of India(SAI) is running four Sports Authority of India Training Centre(STC)/Special Area Games(SAG) Centres in the State of Orissa. Karanjia College, District Mayurbhanj has already been approved as an Extension Centre of STC/SAG for Football. For promotion of Hockey, a synthetic hockey surface is being laid at SAG Centrte, Sunderbagh. Approval has also been given to start five Extension Centres for promotion of Sports in the State of Orissa.

Community Radio Station at Manav Rachna Education Society, Faridabad

 

New Delhi : July 9, 2009

Ministry of Information & Broadcasting, Government of India has signed a Grant of Permission Agreement for establishing, maintaining and operating a Community Radio Station at Manav Rachna Education Society, Faridabad, Haryana. Letter of intent had been issued to the society after recommendations of Inter Ministerial Committee and seeking requisite clearances from various Ministries. The Community Radio Station is expected to be operational within three months as per the agreement. With this, the number of CRS will increase to 51 in the country.

 

The programmes broadcast from the community radio station will provide useful information to the community for their development as well as panel discussions, weather forecasts, entertainment, tips on health including information regarding free health melas organized by Manav Rachna Educational Institutions, free/subsidized OPD facilities in dental care and physiotherapy etc. It will also promote social causes including prevention and eradication of AIDS, Thalassaemia, Dengue, Chickenguenia, Hemophilia, drug abuse etc.

 

The Ministry encourages setting up the Community Radio Station as it promises to provide an opportunity to the local communities to express themselves, share their views and particularly empower the women, youth and the marginalized groups to take part in local self governance and overall socio-economic and cultural development of the area. It will also better inform the society about the developmental initiatives of Government and promote transparency in the implementation of the scheme. Keeping this objective in view, the Government of India had announced a policy in December 2002 for the grant of community radio licenses to the educational institutional.

Expansion of SAIL and RINL

Both the Steel Authority of India Limited (SAIL) and the Rashtriya Ispat Nigam Limited (RINL) are in the process of implementing their expansion programmes. The production of hot metal in SAIL is proposed to be increased from the present level of 14.4 million tonnes per annum to 23.46 million tonnes per annum and the production of liquid steel in RINL is proposed to be increased from the present level of 3.0 million tonnes per annum to 6.3 million tonnes per annum. The cumulative expenditure incurred by SAIL and RINL during the last three years (2006-07 to 2008-09) are Rs. 3799 crores and Rs. 4041 crores respectively.

As part of the overall expansion of SAIL, the hot metal production of Rourkela Steel Plant (RSP) will increase from a level of 2.12 million tonnes per annum (MTPA) to 4.5 million tonnes per annum (MTPA).

A joint venture company viz. International Coal Ventures Private Limited (ICVL) has been set up with Steel Authority of India Limited (SAIL). Coal India Limited (CIL), Rashtriya Ispat Nigam Limited (RINL), National Mineral Development Corporation (NMDC) and National Thermal Power Corporation (NTPC) as the promoters for the purpose of securing metallurgical and thermal coal assets in the overseas territories with the following objectives:

 

(i) To ensure supply of imported metallurgical coal, of at least 10% of the 2019-20 requirements of steel Public Sector Undertakings (PSUs).

 

(ii) To be an owner of about 500 million tonnes of metallurgical coal reserves by 2019-20; and

 

(iii) To meet the requirements and to serve the organizational aspirations of other participating companies like CIL, NTPC and NMDC by providing a facility for enhancing and leveraging their domain knowledge and human capital for international mining business development and also for procuring high quality thermal coal for companies like NTPC.

For achieving long term security in supply of metallurgical and thermal coal, ICVL has identified Australia, New Zealand, Mozambique, Indonesia, USA and Canada as countries for possible sourcing of raw material.

Welfare of Bhopal Gas Victims

Under the ongoing schemes for the welfare of Bhopal Gas Victims 7 hospitals, 5 civil dispensaries and 2 poly clinics and 3 dispensaries each of the Homeopathy, Unani and Indian Medical System are engaged in the medical rehabilitation and care. In addition, 3 more hospitals consisting one each of Ayurveda, Homeopathy and Unani system of medicines are also functioning. Under the economic rehabilitation, training has been provided to the youth of gas affected wards, 42 work-sheds and 152 industrial sheds were constructed for providing employment opportunities in the Units set up in these sheds. Under the social rehabilitation plan 2468 houses have been constructed and allotted to the widows of the gas victims besides providing initial relief measures like pensions to about 1077 widows, distribution of milk to the lactating mothers and the children, etc. Under the environmental rehabilitation, construction of drains, plantation of trees and augmentation of safe drinking water supply has been taken up. In April 2006, Government of India had sanctioned money for a project under the Jawaharlal Nehru National Urban Renewal Mission (JNNURM) and the Government of Madhya Pradesh had sanctioned Rs. 14.18 crore to the Bhopal Municipal Corporation (BMC) for providing safe drinking water through pipelines from the Kolar Reservoir to the 14 localities around the UCIL plant site. The Government of Madhya Pradesh has stated that an amount of Rs. 512.10 crore has been spent on all these schemes, upto 31st March, 2009.

The compensation is being disbursed through the office of the Welfare Commissioner, Bhopal Gas Victims. The Welfare Commissioner's office has informed that as on 31.5.2009, out of 5,74,369 total awarded cases, original compensation of Rs. 1549.03 crore has been paid to 5,73,878 claimants. In addition Rs. 1509.40 crore has been paid to 5,62,488 claimants as pro-rata compensation on the directions of the Supreme Court. 491 claimants have not yet settled their claim for original compensation and 11,881 claimants have not yet settled the pro-rata compensation. The work of payment of compensation is in progress. A list of absentee claimants was notified in newspapers for attending the court to receive the compensation. Besides this a list was also provided to the NGOs as per directions of the Hon'ble Supreme Court. The claims would be settled as and when the absentee claimants turn up.

Creches for the children for the working mothers get Rs.100 crore

The Government has allocated Rs.100 crore in the budget proposals for the year 2009-10 for the opening of more crèches for the children of working mothers. Out of this, Rs.10 crore will be provided for opening of crèche in the north-eastern states.

In view of the increased employment opportunities for women and the need to supplement household income, more and more women require day care services for their children. The Rajiv Gandhi National Crèche Scheme for the children of working mothers of the Ministry of Women and Child Development aims to provide day care services for children in the age group of 0-6 years, belonging to economically weaker sections of society. The women whose family income does not exceed Rs.12000 per month can send their children to Rajiv Gandhi crèche at the users charges of Rs.20/- per child per month. The nominal charges ensure participation with the community and also increase the centers' resources, which can be utilized for better facilities at the crèche.

 

At the moment 22,038 crèches are being provided support throughout the country under the Rajiv Gandhi National Crèche Scheme. The highest priorities given to the backward districts and tribal areas for opening of new crèches. The scheme is implemented and monitored through Central Social Welfare Board of the Ministry in association with Indian Council for Child Welfare.

 

The crèche not only organize pre-school education activities but also provide food with adequate nutritional value. Children are immunized and health record of the health is maintained in the register after the weekly health checkup by a visiting doctor.

Several measures taken to help automobile sector

The Government of India, through three stimulus packages, has taken several measures for revival of Indian automobile sector. These include reduction of excise duty, increasing liquidity and credit flows in the market, etc. In addition, direct demand generation of Commercial Vehicles (CVs) through JNNURM Scheme for procurement of buses and also specific credit flow measures for this segment has been done. In addition, in order to create demand, accelerated depreciation @50 has also been offered for the CV segment.

 

As per the information received from Society of Indian Automobile Manufacturers (SIAM), the total number of automobiles produced in May 2008 was 980067 which has gone up to 1044084 in May 2009, showing a 6.5% increase.

 

The total commercial vehicles sold during the month of May 2009 was 30,800 as compared to 36,141 in May 2008 showing a decrease of (-) 15%. Similarly, the total utility vehicles sold during the month of May 2009 was 16,266 as compared to 22,958 in May 2008 showing a decrease of (-) 29%.

Reports on working of safeguards for SCs and STs

The erstwhile National Commission for Scheduled Castes and Scheduled Tribes (NCSCST) submitted its last report (7th Annual Report) on 19.02.2004. After bifurcation of NCSCST into two Commissions namely the National Commission for Scheduled Castes (NCSC) and the National Commission for Scheduled Tribes (NCST), NCSC submitted its first Annual Report for the year 2004-05 on 17.7.2006, while the National Commission for Scheduled Tribes (NCST) submitted its last report (2nd report) for the year 2006-07 on 3.9.2008.

 

The Ministry of Tribal Affairs has intimated that there was no discussion on the 1st Report of NCST. In the case of NCSC, the 1st Report of the Commission is yet to be laid in Parliament.

 

Action taken reports by the Ministries/Departments concerned on NCSC 1st Annual Report have been obtained and are under compilation. For NCST's 2nd Annual Report for the 2006-07, the Ministry of Tribal Affairs is pursuing the matter with the Ministries/Departments concerned for providing action taken reports.

Reservation in Private Sector

A Group of Ministers was formed in September, 2004, to examine the issue of affirmative action, including reservation in private sector, and to initiate a dialogue with Industry and other associations to fulfill the aspirations of the Scheduled Castes and Scheduled Tribes youth. The Group met five times and also held consultations with the representatives of Apex Industry Associations. In October, 2006, a Coordination Committee was constituted under the chairmanship of the Principal Secretary to the Prime Minister, to carry forward the dialogue with Industry on affirmative action in private sector. The Committee has held discussions with representatives of Apex Industry Chambers/Associations. As decided in the third meeting of the Coordination Committee, held on 11.7.2008, a Group of Officers has been constituted in September, 2008, to study the issue of providing fiscal incentives to industries for setting up manufacturing units in backward districts with large SC/ST population.

Jobs for disabled persons

Section 33 of the Persons with Disability (Equal Opportunity, Protection of Rights and Full Participation) Act, 1995 provides for 3% reservation in government employment, including 1%each for disabled persons suffering from (i) blindness or low vision; (ii) hearing impairment and (iii) loco motor disability or cerebral palsy. Moreover, a special recruitment drive has been initiated recently to fill up backlog vacancies for posts reserved for persons with disabilities.

 

No directions have been issued to the private sector to create jobs for disabled persons. However, a new Scheme of Incentives to the Private Sector for Employment of Physically Challenged Persons has been launched, w.e.f. 01.04.2008. Under this Scheme, the Government of India provides the employer's contribution for Employees Provident Fund (EPF) and Employees State Insurance (ESI) for 3 years, for physically challenged employees employed in the private sector on or after 01.04.2008, with a monthly salary upto Rs. 25,000.

Rehabilitation of mentally ill persons

Epidemiological studies conducted under the aegis of the Ministry of Health & Family Welfare during 2002-05 indicate that 1 to 2% of the total population suffer from severe mental disorders, and 5 to 7% suffer from minor metal disorders. State-wise date is not available. (c) The Mental Health Act, 1987, has provisions regarding treatment of persons with mental illness. Likewise, the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, has provisions regarding rehabilitation of persons with disabilities, including those suffering from mental illness.

The Ministry of Health & Family Welfare supplements State Governments' efforts through District Mental Health Programme, Strengthening of Psychiatric Wings of Medical Colleges/General Hospitals and Modernization/Upgradation of Metal Hospitals to make them as therapeutic units.

The Ministry of Social Justice & Empowerment provides assistance to NGOs for providing rehabilitation services to persons with disabilities, including persons with mental illness, by way of setting up Vocational Training Centres, Home-based Rehabilitation, and Community-based Rehabilitation etc. In addition, assistance is also given to run Half Way Homes for mentally ill persons.

Hostels meant for SC/ST students

The report of the Comptroller and Auditor General of India (of 2007) has pointed out some cases of misutilization of hostels meant for SC/ST students for other purposes, in Assam, Jharkhand, Manipur, Haryana, Tamil Nadu, Uttar Pradesh and West Bengal. Some instances of misutilization are, use of hostel buildings for running of Govt. offices, schools, beggars' home, staff residence etc.

 

The maintenance and proper utilization of hostels is the responsibility of the concerned State Government/UT Administration/implementing agencies. The instances of misutilization as brought out in the report of the Comptroller and Auditor General have been communicated to the concerned State Governments for remedial measures and submission of compliance reports.

Reservoirs with storage capacity

There are major and medium water resources storage projects in the country under construction in the XI Plan, with their total live storage capacity is 63.90 BCM as per the information available from Central Water Commission.

 

The total design storage capacity of 81 reservoirs monitored by Central Water Commission is 151.768 Billion Cubic Metres (BCM). Water is a State subject and the construction of such reservoirs is an on-going activity of the various State Governments in order to harness the available water resources. Many such big reservoirs have been, and are, planned and constructed under different Five Year Plans by the State Governments with their own resources and also funds made available to them by the Central Government. Ministry of Water Resources provides funds to the State Governments under Accelerated Irrigation Benefits Programme (AIBP).

Decline in flow of big rivers

Mr. Aiguo Dai and others carried out a study on "Changes in Continental Freshwater Discharge from 1948 to 2004" which was published in the Journal of Climate. The authors have concluded that the results reveal large variations in yearly stream flow for most of the world's large rivers and for continental discharge. Authors have found that out of the top 200 rivers, there is no significant trend in case of 136 rivers whereas 19 rivers have shown upward trend and 45 rivers have shown downward trend. Details of the findings in respect of all the 925 rivers are not reported in the paper.

The study found that annual freshwater discharge into Pacific Ocean fell by about 6% or 526 cubic kilometer - approximately the same volume of water that flows out of Mississippi river each year, as per a news release. The news release further states that annual flow into India Ocean dropped by about 3% or 140 cubic kilometer.

Authors have made numerous assumptions and have mentioned in the paper that they "emphasize that stream flow, like precipitation, has very large year-to-year variations, which make detection of changes more difficult". Authors have further observed that their "results contradict the notion that global runoff has increased during the recent decades". "Comprehensive water data base in public domain and assessment of the impact of climate change on water resources" has been included as one of the goal in the draft mission document for "National Water Mission".

Cases referred to the Serious Fraud Investigation Office

            In all, 37 cases were referred to the Serious Fraud Investigation Office (SFIO) during the last three years i.e. during the years 2006-07, 2007-08 and 2008-09.

            Out of these 37 cases, investigations in respect of 9 cases have been completed.  The number of people in respect of three cases against whom action has been initiated are as follows :

            Number of people in respect of other six companies will be known only after launching prosecutions.         The nature/details of the nine cases referred to above is given in Annex - I.  In respect of the remaining 28 cases, investigations are under progress. 

            An elaborate regulatory framework is in place to deal with such incidents.  This framework provides for statutory disclosures about the affairs of companies intended to inform the stakeholder the truth about the state of affairs of companies. To facilitate making of such disclosures by companies, and for stakeholders and regulatory agencies to easily access and view them, Government has set up an electronic registry with round the clock access through internet.  The Government has powers of inspection of the books of accounts of companies and also to investigate their affairs, if need be, under the Companies Act, 1956.  In addition, the Act provides for appointment of independent, statutory auditors to audit the accounts and report to the shareholders.  Such audited accounts are also displayed on the electronic registry for general viewing.  While the reporting requirements are regulated under the Companies Act, 1956, the conduct of auditors is regulated under the Chartered Accountants Act, 1949.  In addition, for listed companies, compliance with these statutory requirements is required to be certified by a company secretary in practice, who in turn is regulated under the Company Secretaries Act, 1980.  Government has amended the Chartered Accountants Act, 1949 and the Company Secretaries Act, 1980 in 2006 to provide for a more effective disciplinary mechanism  to deal with cases of misconduct by Chartered Accountants, Company Secretaries respectively.  In 2006, the Government has notified Accounting Standards to enable accounts of companies to be drawn up and disclosed on the basis of fair, transparent and internationally accepted principles.  Government proposes to re-introduce Companies Bill, 2008 as the Companies Bill, 2009 which seeks to make more stringent provisions in cases of frauds by companies, their directors and auditors, etc.

Shonkh Technologies Ltd.

The promoters in this case were found to have caused wrongful loss to the company by allotting shares at arbitrary rates of premium to Directors and their relatives.  They were also found guilty of falsification of accounts by creation of false equity through rotation of cheques and by showing fictitious sales to inflate revenue and profit.

The Directors of the Company were found to have violated various provisions of Companies Act including preparation of Annual Reports in a manner not reflecting true and fair view of the operations of the Company.

These four companies are part of JVG Group of 13 companies referred to SFIO for Investigation.  The main promoter is Shri Vijay Kumar Sharma.  There are allegations of siphoning off funds invested by the public in JVG Finance Limited, which was a non-banking finance company, and some of these companies were used for this purpose.

Leafin India Limited

The funds of the Company were siphoned off by creation of lease agreements in respect of non-existent assets and lease rentals were paid thereon.  There was an attempt to defraud the exchequer.

Stock Holding Corporation of India Limited (SHCIL)

There was fraudulent issue of shares of the company and books of accounts were falsified.  The management was found guilty of the offence of criminal breach of trust in transferring tangible assets of the company.  The officials of the company intentionally gave false evidence on oath during investigation.
