INDIA AND DENMARK SIGN SOCIAL SECURITY AGREEMENT
New Delhi, Magha 28, 1931
February 17, 2010
India and Denmark signed bilateral Social Security Agreement (SSA)
here today. The agreement was signed by Dr. A. Didar Singh, Secretary,
Ministry of Overseas Indian Affairs and Ms Inger Stojberg, Minister
for Employment of Denmark. Before the signing, a bilateral meeting
was held between the Indian and the Danish delegations to discuss the
way forward for implementation of the agreement. On the occasion, Dr.
A. Didar Singh said that it is a significant agreement with Denmark
and it will further strengthen the bilateral relations between the two
countries.
Highlighting the feature of the agreement, Shri Singh said that the
agreement will enhance cooperation on social security between the two
countries with a view to protect their workers in either country
against double payment of social security contributions, loss of
contributions and loss of benefits. He said that the detached (posted)
workers sent by Denmark based companies to their Indian subsidiaries,
or those sent by Indian companies to their subsidiaries in Denmark
will be exempt from social security contribution under the host
country's legislation. While working abroad, these employees will only
be subject to the social security regulations of their home country.
He further said that the SSA provides that an employed or
self-employed person, other than detached workers, shall be subject
only to the legislation of the host country. It also provides for
portability of the benefits at the time of relocation to home country
or a third country.
The Secretary said that the bilateral agreement will also help enhance
trade and investment between the two countries on account of reduction
of corporate expenses on social security and will ensure social
protection of migrant professionals. He said that a Joint Working
Group will be set up to draw a detail of framework of the agreement.
The SSA will come into effect after completion of the requisite
procedures by both countries. India already has signed an MOU on
Labour Mobility Partnership with Denmark in September, 2009.
India has signed Social Security agreements with Belgium, France,
Germany, Switzerland, Luxembourg and the Netherlands in the recent
past. Similar agreements with other countries like Canada, South
Korea, Czech Republic and USA are underway. There are about 13,000
Indians in Denmark most of whom are working as professionals and
self-employed persons.
