Dalit looses legs when tied to railway track by Gujjars in U.P.; NHRC issues notice to the State Government on media report
New Delhi, July 25th, 2012

Taking suo motu cognizance of a media report that a 22 year old Dalit was brutally assaulted and lost his legs when tied to railway track by some Gujjars in Western Uttar Pradesh, the National Human Rights Commission has issued notices to the State Chief Secretary and the District Magistrate, Ghaziabad calling for reports within four weeks. Allegedly, the victim Tika Ram had been admitted to All India Institute of Medical Sciences, Delhi where doctors had to amputate his legs and they were not positive about his survival. The media carried report on the 20th July, 2012.

Reportedly, the assault on Tika Ram is directly related to a dispute over 4.75 bighas of Panchayat land allotted to the 60 Jatav families by the State Government. However, the Gram Pradhan had occupied the land. Restricting movement of Jatavs, he had built a seven-foot high wall around the land. On the 14th March, 2012 as well, the Gujjars had beaten up Jatavs severely injuring them in broad day light.

The Commission has observed that the allegations, if true, raise a serious issue of human rights violation of Dalits.

Seeking reports on the March incident also along with attack on Tika Ram, the Commission has further directed the State Chief Secretary and the District magistrate, Ghaziabad to inform:

a) What legal action had been taken against the accused involved in the two incidents of attack on Dalis; and

b) Whether the Government proposes to grant any compensation to the victim Tika Ram under the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act?
