The Congress admitted that P.J. Thomas' appointment as Chief Vigilance Commissioner was an "error" but rejected demands for the resignation of Prime Minister Manmohan Singh and Home Minister P. Chidambaram who were part of the selection panel in the wake of the Supreme Court order quashing the appointment.

Congress spokesman Abhishek Manu Singhvi said that it was wrong to politicise what is a legal verdict based on legal considerations and added that he disagreed with the generalisation that what is legally wrong is morally wrong.

"Invalidation of the appointment is not a matter of malafide. The error has been set right by a legal judgment. It is a judgement by the highest court and binding on all. We bow before it," he said.

Replying to a volley of questions whether the prime minister and home minister should quit owning moral responsibility for the appointment of Thomas as CVC, Singhvi said there was no need.

"Absolutely not," he said.

The prime minister and home minister were part of the panel to decide the appointment of CVC. Bharatiya Janata Party (BJP) leader Sushma Swaraj, who was the third member of the panel, had objected to appointment of Thomas due to a pending corruption case against him.

Asked whether the apex court ruling was an embarrassment for the Congress and the government, Singhvi said an error had occurred and was the reason for the court's intervention.

On questions about the prime minister's statement that Caesar's wife should be above suspicion, Singhvi said the apex court has not spoken of malafide even indirectly.

Singhvi said that courts give hundreds of such judgements correcting legal errors by the central and the state governments and in no case were motives attributed.

The Supreme Court Thursday struck down the appointment of Thomas as the CVC, six months after he was appointed to the post, for his alleged involvement in a corruption case.

Union Budget 2011 provides policy direction on tax

The Union Budget 2011-12 will go down in history as one that provided a clear vision on taxation policy. No bigbang announcements, no major tax cuts, yet it is a balanced Budget given the tough economic and political environment in the country. The finance minister showed confidence that the country's GDP for 2011-12 would grow above 9% and has sent a strong signal of continued growth to the world at large. On the policy front, the finance minister has reaffirmed that the new Direct Taxes Code (DTC) will be effective from April 1, 2012, and expects all stakeholders to be prepared for the same well in advance. With the inception of the DTC, the government's vision appears to be clear: to make taxes moderate, payments simple and tax collection easier.


The finance minister has emphasised on making compliance simpler for individuals, the largest proportion of return-filing population. The government not only fancies to improve the efficiency of the entire system through better IT infrastructure but, more importantly , it aims to free its resources from mundane tasks. The clear intent of the finance minister in this Budget is to enable the machinery to tackle the menace of generation and circulation of black money. Thus, the policy of the government is spelt out clearly in this Budget. Another policy measure worth discussing is the focus of the government on tackling and curbing tax litigation. Today, this appears to be one area that requires immediate attention. Substantial revenue remains locked in the prolonged appellate process consuming substantial efforts and blocking the revenue of the government.


The focus of the government is clear — target high revenue cases. There is also an intent to curb litigation by providing speedy settlement to the taxpayers by providing alternative avenues to reach to a final settlement. And so, three more benches of the Settlement Commission is proposed to be set up this year. However, the government needs to consider enlarging the scope of cases that can be dealt by the Settlement Commissions. The other focus areas of the government include increase in infrastructure growth. The finance minister has introduced tax-free bonds worth . 30,000 crore and has proposed to set up infrastructure debt funds. It has been specifically provided that interest income to a non-resident from infrastructure debt funds will be taxed at 5% (plus applicable surcharge and education cess) against the current tax rate of 20%. This will enable India to attract foreign investments, necessary to keep the growth pace intact.


Another policy measure introduced is to tax the dividend received by domestic companies from its overseas subsidiary at a concessional rate of 15%, allowing for funds to be brought back for further investment . Further, measures to provide higher weighted deduction from 175% to 200% for contribution to National Laboratory, University, etc, largely fits into the Budget theme. The finance minister showed his concern towards the rising generation and circulation of black money in India. The government will notify certain foreign jurisdictions that are reluctant to cooperate in exchange of effective information . It is proposed that transfer pricing regulations would apply on transactions with any person located in such area and no deduction for any expenses arising from the deals shall be allowed unless the taxpayer provides prescribed particulars. This Budget admittedly has not provided big relief to individual taxpayers in terms of absolute tax saving .

BOLANGIR ( ORISSA )): A senior official of a private steel plant died after his vehicle was set a fire by some people outside the factory at Titlagarh, about 75 km from here on Thursday, police said.

RS Roy, deputy general manager (Operations) of Graphite India Ltd-Powmex steel division was coming out of the plant in a jeep along with two others during lunch break when the incident took place, SP Ajaya Kumar Sadangi said.

Some of the suspended workers , who were staging a dharna outside the plant for the past several months, stopped the car and asked the driver and others to disembark, he said.

As the driver and two others got down, some people suddenly set fire to the vehicle with Roy sitting inside the car, Sadangi said, adding the DGM sustained severe burns and was immediately taken to Titilagarh sub-divisional hospital.

He was then shifted to Ispat General Hospital (IGH) at Rourkela when he passed away in Bolangir town, Sadangi said.

The agitating labourers received information that the factory authorities were planning to terminate the services of some of them, police said.

Though the vehicle was stopped by the agitating labourers, it was not immediately clear as to who set the vehicle on fire, they said.

NREGA activist Reetika Khera said, "He was carried by his family on a charpouy. hey walked 10 kilometers before reaching the Manika thana. From there they took his to the hospital, but he died when he reached the hospital."

Niyamat had been in the forefront of exposing corruption in the UPA's ambitious job guarantee programme in Jharkhand. The most recent being just weeks back in the Manika block.

Latehar District Collector Rahul Purwar said, "We have constituted a special task force. We are positive that the culprits will be nabbed soon. It was very unfortunate."

Niyamat's murder has sent shock waves among NREGA activists across the country. Sources in the rural development ministry say they were aware of Niyamat's case and were in touch with the government of Jharkhand just four days back.The ministry is considering sending a fact finding team and even handing the case to the CBI. Many activists are demanding prompt action.

Activist Jean Dreze said,"We demand that immediate action be taken, the culprits are known in the area.. They must be arrested immediately."

The NAC member, who has extensively worked in Jharkhand says,"There have been a series of such incidents going back to lalit mehta who was murdered a few years ago in the same area. And that the latest incident is just the logical conclusion of the complete impunity that has been given to criminal elements in Jharkhand. And that state insitutions are increasingly becoming parts of this criminal nexus."

NAC Member Harsh Mandar said, "Tis is not the first incident and nor will it be the last. It just shows what a hugh risk business it has become for an individual to say, ' I will not accept corruption'."

In the FIR, six people have been named so far, two are prominent contractors and one, called Sudarshan is known as a Maoist in that area.

Even earlier, there was an attempt on Niyamat's life. Not only did the local authorities failed to prevent the attack, even the ambulance did not reach him on time. Perhaps when the whistle blowers act is finally passed by paliament, it will become impossible for the local authorities to ignore threat perceptions.

Nikhil Dey, NREGS and RTI activist says, "What is to blame right now is that citizens have got access to information which is damaging for vested interest. There are powerful vested interests who are becoming more and more powerful through a combination of violence, crime and money. Every RTI activist is a whistle blower because a citizen can access that information and then blow the whistle on corruption. The whistle blowers act has to deal with that scenario."

The murder of Niyamat Ansari brings back memories of the the murder of Lalit Mehta, one of the first RTI activists who paid for battling corruption with his life. No one has been brought to book in that case yet. A poignant reminder for the government to ensure safety of whistle-blowers working in most inhospitable terrain.
